1. Acceptance of Terms
By using the services of Amberwood Carson Tree Service, you agree to these Terms of Service. If you do not agree with any part of these terms, please do not use our services. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of our services after any changes means you accept the updated terms.
2. Services Provided
Amberwood Carson Tree Service provides professional tree care services including but not limited to tree removal, tree trimming and pruning, stump grinding, emergency tree services, land clearing, tree health maintenance, arborist consulting, and shrub and hedge trimming. All services are performed by trained and certified professionals using industry-standard equipment and safety practices.
3. Estimates and Pricing
We provide free estimates for our services. Estimates are based on the information available at the time of inspection and are subject to change if conditions differ once work begins. Final pricing may vary if additional work is required due to unforeseen circumstances such as hidden hazards, additional tree damage, or site conditions not visible during the initial assessment. We will notify you of any significant price changes before proceeding with additional work.
4. Payment Terms
Payment is due upon completion of services unless other arrangements have been made in writing. We accept cash, checks, and major credit cards. If payment is not received within 30 days of service completion, a late fee may be applied. You are responsible for any collection costs or legal fees incurred if we need to pursue payment through collections or legal action.
5. Cancellations and Rescheduling
If you need to cancel or reschedule your appointment, please contact us at least 24 hours in advance. Cancellations made with less than 24 hours notice may result in a cancellation fee. We understand that emergencies happen, and we will work with you to reschedule at a convenient time whenever possible.
6. Property Access and Preparation
You are responsible for ensuring that our crew has clear access to the work area. This includes unlocking gates, moving vehicles, and securing pets. If we arrive and cannot access the work site due to blocked access or unsafe conditions, you may be charged a trip fee. We will make every effort to protect your property during our work, but you should remove or secure any fragile items, outdoor furniture, or decorations near the work area before we arrive.
7. Liability and Insurance
Amberwood Carson Tree Service is fully licensed and insured. We carry general liability insurance and workers compensation insurance to protect you and our crew. While we take every precaution to prevent property damage, we are not responsible for damage caused by conditions beyond our control, such as hidden decay in trees, underground utilities not marked by the appropriate agencies, or pre-existing damage to structures. If damage occurs due to our negligence, we will work with you and our insurance company to resolve the issue fairly.
8. Permits and Regulations
You are responsible for obtaining any necessary permits required by your city or homeowners association before tree work begins. We can advise you on whether permits may be needed, but it is your responsibility to secure them. If work must be stopped due to lack of proper permits, you may still be responsible for payment for any work already completed.
9. Weather and Delays
Tree work is weather-dependent. If unsafe weather conditions arise, such as high winds, heavy rain, or lightning, we may need to postpone or reschedule your service for safety reasons. We will notify you as soon as possible and work with you to find a new date that works for both parties. We are not liable for delays caused by weather or other circumstances beyond our control.
10. Limitation of Liability
Our liability is limited to the amount you paid for the services performed. We are not responsible for indirect, incidental, or consequential damages arising from our services. This includes but is not limited to loss of use of property, lost profits, or emotional distress. Some states do not allow the exclusion or limitation of certain damages, so this limitation may not apply to you.
11. Disputes and Governing Law
These terms are governed by the laws of the State of California. Any disputes arising from these terms or our services will be resolved through binding arbitration in Los Angeles County, California, unless both parties agree to pursue resolution through small claims court. You waive your right to participate in class action lawsuits or class-wide arbitration.
